1.Acceptance of Terms

By accessing or using PocketDex (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and PocketDex (“we,” “our,” or “us”). We reserve the right to update these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2.Description of Service

PocketDex is a trading card portfolio tracking application that allows users to track their collectible card collections, monitor estimated portfolio value, and connect with other collectors. The Service includes:

(a)A portfolio tracking tool with P&L analytics
(b)A card scanning feature using image recognition technology
(c)A classifieds marketplace for connecting buyers and sellers of trading cards
(d)Community features including friends, leaderboards, and showcases
(e)Vendor account features for card shop owners and dealers

PocketDex is not a financial services platform. All pricing data displayed is estimated market value sourced from third-party providers and is not financial advice. Nothing in the Service constitutes a recommendation to buy or sell any collectible or investment.

3.User Accounts

3.1 Registration. You must create an account to use most features of the Service. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

3.2 Age. You must be at least 13 years of age to use PocketDex. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3.3 Responsibility. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@pocketdex.app of any unauthorized access to or use of your account.

3.4 Account Termination. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.

4.Acceptable Use Policy

You agree NOT to:

—Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
—Post, transmit, or share content that is fraudulent, misleading, defamatory, harassing, hateful, or that violates the rights of others
—List counterfeit, stolen, or misrepresented items on the marketplace
—Attempt to gain unauthorized access to any part of the Service, its systems, or related networks
—Use automated tools, scrapers, or bots to access the Service without our written permission
—Impersonate another person, entity, or PocketDex staff member
—Interfere with the operation of the Service or degrade other users' experience
—Upload malware, viruses, or any other malicious code

Violation of this policy may result in immediate account suspension or termination.

5.Marketplace Rules

5.1 No Payment Processing. PocketDex does not facilitate, process, or handle payments between users. The Marketplace is a classifieds platform only — a venue for users to connect. All payment arrangements are made entirely between buyers and sellers.

5.2 Not a Party to Transactions.

PocketDex is NOT a party to any transaction between users. We make no representations or warranties about the quality, safety, or legality of items listed, the accuracy of listings, the ability of sellers to sell, or the ability of buyers to pay.

5.3 User Risk. You agree that transactions conducted through connections made on PocketDex Marketplace are at your own risk. We strongly encourage you to follow our Safety Tips, available in the Marketplace Guide.

5.4 Prohibited Items. You may not list counterfeit items, stolen goods, items you do not own or have no right to sell, or items that misrepresent condition or authenticity.

5.5 Seller Responsibility. Sellers are solely responsible for the accuracy of their listings, including card condition, authenticity, and descriptions. Misrepresentation may result in account action.

5.6 No Guarantees. PocketDex makes no guarantee that any listing will result in a transaction, or that any buyer or seller will fulfil their stated obligations.

6.User Content

6.1 Ownership. You retain ownership of content you post to PocketDex, including photos, descriptions, showcase content, and any other materials you submit.

6.2 License. By posting content to PocketDex, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and use that content in connection with operating and promoting the Service.

6.3 Responsibility. You are solely responsible for all content you post. You represent and warrant that you have all necessary rights to post any content you submit, and that it does not infringe the rights of any third party.

6.4 Removal. We reserve the right to remove, without notice, any content that violates these Terms or our Community Guidelines.

7.Intellectual Property

7.1 Our IP. PocketDex, its logo, and all original Service content, software, and design are owned by PocketDex and protected by applicable intellectual property laws.

7.2 Third-Party Card Content. Trading card names, images, and related intellectual property belong to their respective owners (game publishers, manufacturers, and licensors). PocketDex references this content for identification and collection-tracking purposes only and makes no claim of ownership over third-party card content.

7.3 Price Data. Pricing data is provided by pokemontcg.io under their applicable terms. PocketDex does not claim ownership of any third-party pricing or card database data.

7.4 Restrictions. You may not reproduce, distribute, modify, or create derivative works of PocketDex software or original content without our prior written permission.

8.Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using PocketDex, you consent to the data practices described in our Privacy Policy.

9.Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ALL PRICE DATA IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A GUARANTEE OF ACTUAL MARKET VALUE.

10.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POCKETDEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY LOSSES RESULTING FROM TRANSACTIONS BETWEEN USERS. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

11.Indemnification

You agree to indemnify, defend, and hold harmless PocketDex, its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; (d) any transaction you conduct through the Marketplace; or (e) your violation of any applicable law or the rights of any third party.

12.Third-Party Services

The Service integrates with third-party services. Their terms and privacy policies apply to your interactions with those services, and PocketDex is not responsible for their practices or content.

13.Pricing and Business Promotion

13.1 User Access. PocketDex is currently offered free to collectors and dealers using the core product. No user subscription is required to access the main tracking, marketplace, and community features described on the site.

13.2 Business Promotion Products. We may offer paid promotional products, advertising placements, sponsored listings, featured vendor tools, or event promotion services for stores, organizers, and other businesses.

13.3 Future Pricing Changes. We may introduce, remove, or modify pricing for business-facing promotion products or other optional commercial services in the future. Any material pricing changes will be reflected on the applicable pages or commercial agreements.

13.4 Separate Terms. Certain business-facing advertising, promotion, or sponsored placement products may be governed by additional terms, insertion orders, or commercial agreements where applicable.

14.Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms, fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time through Account Settings. Provisions of these Terms that by their nature should survive termination — including Sections 6, 7, 9, 10, 11, and 15 — will continue to apply.

15.Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada. You irrevocably consent to the personal jurisdiction of such courts.

16.Changes to Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our practices. We will notify you of material changes by posting the new Terms with an updated “Last Updated” date and, where appropriate, sending you a notification via email or in-app message. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
